Notice on Strengthening Control of Radio Equipments on AliExpress

Dear sellers,

Radio equipment is a type of electronic device that can transmit or receive radio waves. These devices use the radio spectrum. To ensure safety and effectiveness and avoid interference with other radio communications, radio equipment shall meet local regulations before being put on the market. Therefore, AliExpress will implement compulsory control measures on radio equipment into the EU and US markets from late October 2020.

I. Scope

The first batch of radio equipment to be controlled includes headsets with radio functions, wireless remote control products such as remote alarm systems, remote doorbells and remote switches, anti candid camera/anti wiretapping detectors, and Baofeng walkie-talkies (model: BF-888S). The first 8 subcategories under control include:

II. Requirements

When a seller lists radio equipment on the platform, the seller must select the certification and enter or upload the corresponding product certification information. Specific certification requirements are as follows:

• CE marking, EU Declaration of Compliance (DoC) and physical label information are required to enter the EU market
• FCC certificate is required to enter the US market

Before radio equipment is sold to the EU market, the products shall obtain CE-related compliance materials. When listing a product, the seller shall upload a picture of the product packaging or label that contains the CE marking, as well as the EU Declaration of Compliance (DoC) drafted by the manufacturer or the Certificate of Certification (CoC) issued by the relevant institution. The seller shall mark the name of the manufacturer on the product label and the correspondence address where the manufacturer can be contacted.

For the Germany market, in accordance with local laws and regulations, the following radio products will be banned:

Wireless remote control products and anti candid camera/anti wiretapping detectors in the 315 MHz frequency band

Headphones in the 87.5 MHz and lower frequency band

Baofeng BF-888S walkie-talkies

III. Time

The platform will implement mandatory control of newly listed and edited radio equipment in the above eight subcategories in the Germany market from late October 2020, and will clear out stock products that do not meet the certification requirements from mid-November 2020. Products that fail the platform review will be blocked from Germany market. Please upload the certification in time.

IV. Violations and penalties

1. Products that fail to meet the above requirements will be blocked from Germany market on the platform.

2. For products that are miscategorized to evade controls, the following penalties will be imposed:

For the first-time violation, the commodities will be pulled off the shelf with no points deducted. The commodities will be removed from the platform for the second-time violation. For a merchant who evades the controls maliciously more than once, its commodities will be removed from the platform with two points deducted.

3. Sellers who submit fake certification or certification owned by another seller will be subject to the following penalties:

If a seller submits fake CE marking or certification owned by another seller, the product will be deleted and six points will be deducted from the seller's account.

For accounts with severe violations, the platform will impose penalties in accordance with AliExpress Rules on Handling Severe Disruption of Platform Order: 
Serious violation: 12 points/time, freezing the AliExpress account for seven days;
Extremely serious violation: 48 points/time, closing the AliExpress account.
